Terms and Conditions of Sale

The Modress website reserves the right to modify the present terms and conditions of sale at any time by publishing a new version on the website. You are therefore advised to regularly refer to the latest version of our General Conditions of Sale.


The customer acknowledges having read, at the time of placing the order, the terms of sale set out below and declares to accept them.

1. PRODUCTS - PRICES

1.1. Products

Only the Products listed on the Site on the day of its consultation by the Customer are offered for sale. Product offers are limited to Metropolitan France and to member countries of the European Union. Product offers and prices are valid, within the limits of available stocks, as long as they are visible on the site.

1.2. Prices

The prices of our products are indicated in euros, including all taxes and excluding shipping costs, knowing that the shipping costs are added to the amount of the order. We reserve the right to modify our prices at any time but we commit ourselves to apply the current prices which will have been indicated to you at the time of your order. In case of an order to a country other than France, you are the importer of the products concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not concern our spring. They will be at your expense and are your responsibility both in terms of declarations and payments to the authorities and competent bodies in your country. We advise you to inquire about these aspects with your local authorities.

2. ORDER - PAYMENT

2.1 Order validation

The validation of the confirmation of the basket constitutes an electronic signature. This signature has the same value between the Parties as a handwritten signature and is proof of the completeness of the order and the due date of the sums due in execution of said order. As soon as he has validated his order, the Customer becomes a Buyer. Notwithstanding the application of article R624-3 of the penal code, the Customer will pay his order by bank card (credit card, Visa, Eurocard/Mastercard). If the Customer wishes to pay his order by credit card, he must transmit his credit card number. Depending on the type of card, the expiry date of the card and the cryptogram number.

2.2 Contract

When you place an order you will receive an email acknowledging receipt of your order. This e-mail is only an acknowledgement of receipt and does not constitute acceptance of your order. The contract will be formed at the time of the validation of the order and its payment. Only the products listed in the confirmation email sent at the time of shipment will be included in the contract.

2.3 Payment

Upon receipt of your order, we will pre-authorize your payment card to verify that there are sufficient funds to cover the transaction. Products will not be shipped until this pre-authorization process has been completed. Your payment card will be charged once the order is accepted.

3. DELIVERY

Modress will make every effort to have your order delivered within 48 to 72 hours after your order has been shipped. Orders placed on Modress.com are processed and shipped within 24 hours, Monday through Friday, excluding holidays, upon receipt of payment. All orders placed on weekends or holidays will be processed on the next business day.

It is specified that the orders registered on the website Modress.com on Friday afternoon, Saturday or Sunday are processed on the following Monday. Orders placed on the website www.Modress.com on a holiday other than Friday, Saturday or Sunday will also be processed on the next working day. The Products ordered by the Purchaser are delivered in Metropolitan France and all the countries of the European Union, to the address indicated by the Purchaser on the page of the final validation of its order, accompanied by a delivery order. The Buyer has the possibility to have the Products delivered to another address than his own. Modress can be exempted from all or part of its responsibility concerning the inconvenience of delivery by proving that the non-performance or the bad execution of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure.

The articles are delivered within the limits of available stocks. In case of unavailability of the ordered product, Modress will honor the order for the other products, the Customer will be invoiced only for the products actually shipped.

4. RIGHT OF WITHDRAWAL

The Buyer has a period of 30 working days from the date of receipt to return, at his own expense or by Mondial Relay (4€ will be deducted from the order for a return with Mondial Relay), the product he has ordered. The product must be returned in its original packaging and in new condition. If the above mentioned conditions are fulfilled, Modress will refund the buyer the total amount of the products, within thirty days from the receipt by Modress of the products.
